1. Agreement and eligibility
By creating an account or using DraftAhead, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the service.
You must be at least 18 years old, legally able to enter a contract, and located where DraftAhead is offered. DraftAhead is not currently offered in the European Union or the United Kingdom, and additional locations may be unavailable because of legal, payment, provider, or operational restrictions. If you use DraftAhead for an organization, you represent that you are authorized to bind that organization.
2. The service
DraftAhead connects to Gmail and, when enabled, Google Calendar to organize messages, apply DraftAhead labels, create reviewable drafts, learn a compact writing-style profile, identify follow-ups, and suggest scheduling availability. Features may change as the service develops.
DraftAhead does not send email for you. It does not archive, delete, or mark messages as read. You control whether any draft is edited or sent.
3. Your account and connected services
You are responsible for your account activity and for keeping your Google account secure. You authorize DraftAhead to access and act on the connected Gmail and Calendar account only as described in the product and Privacy Policy.
You represent that you have the right to connect the mailbox and provide its content for processing. You must not connect an account or process information through DraftAhead in violation of law, contract, employer policy, or another person's rights.
4. AI-generated results
AI classifications, drafts, follow-up assessments, and scheduling suggestions may be incomplete, inaccurate, or inappropriate. DraftAhead is an assistive tool, not a substitute for your judgment. You must review drafts, recipients, facts, dates, commitments, attachments, confidentiality, and legal or professional obligations before sending or relying on any output.
DraftAhead does not provide legal, medical, financial, employment, or other professional advice.
5. Acceptable use
You may not use DraftAhead to violate law or rights; access an account without authorization; send spam, fraud, harassment, malware, or illegal content; bypass service or provider limits; interfere with security; reverse engineer the service except where law permits; or use outputs as the sole basis for decisions that have legal or similarly significant effects on another person.
We may investigate suspected misuse and suspend or terminate access when reasonably necessary to protect DraftAhead, users, providers, or others.
6. Subscriptions, cancellation, and refunds
Paid plans renew automatically until canceled. Prices, billing frequency, cancellation timing, refund rules, and Paddle's merchant-of-record role are described in the Subscription & Refund Policy, which is incorporated into these Terms.
You authorize Paddle to charge the payment method selected at checkout for recurring charges after you provide separate subscription consent. Paddle's buyer terms and privacy notice also apply to the payment transaction.
7. Your content and our intellectual property
You retain ownership of your email content, instructions, rules, and other material you provide. You grant DraftAhead a limited, nonexclusive license to access, process, transmit, and modify that material only as needed to provide, secure, and support the service.
DraftAhead and its software, design, documentation, trademarks, and other service materials are owned by DraftAhead or its licensors. Subject to these Terms, DraftAhead gives you a limited, revocable, nontransferable right to use the service for your internal personal or business purposes.
If you send feedback, you permit DraftAhead to use it without restriction or compensation, provided we do not identify you publicly without permission.
8. Third-party services
DraftAhead depends on services including Google, OpenAI, Paddle, and hosting providers. Your use of those services may be governed by their terms. We are not responsible for third-party outages, policy changes, model behavior, or account restrictions. AI processing used by DraftAhead's advertised features is included in your DraftAhead subscription and is not separately billed to you by OpenAI.
9. Availability and termination
We may modify, limit, suspend, or discontinue features, including for maintenance, security, legal compliance, provider changes, or abuse prevention. You may stop using DraftAhead, disconnect Gmail, cancel your subscription, or delete your account at any time.
Provisions that by their nature should survive— including payment obligations, ownership, disclaimers, liability limits, and dispute terms—continue after termination.
10. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRAFTAHEAD IS PROVIDED “AS IS” AND “AS AVAILABLE.” DRAFTAHEAD DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. Some states do not allow certain disclaimers, so portions of this section may not apply to you.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRAFTAHEAD WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL. DRAFTAHEAD'S TOTAL LIABILITY ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID FOR DRAFTAHEAD DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limits do not apply where prohibited by law or to liability that cannot legally be limited.
12. General terms
Applicable United States federal law and the mandatory laws of your jurisdiction govern these Terms without depriving you of non-waivable consumer protections. Before filing a claim, you and DraftAhead agree to make a good-faith effort to resolve the dispute by email.
If a provision is unenforceable, the remaining provisions remain effective. A delay in enforcing a right is not a waiver. You may not assign these Terms without our consent; DraftAhead may assign them in connection with a reorganization, financing, merger, or sale. These Terms, the Privacy Policy, and Subscription & Refund Policy form the complete agreement about the service.
13. Changes and contact
We may update these Terms. Material changes will be presented for renewed agreement before continued use when appropriate. Contact [email protected] with questions or dispute notices.
